Capital gains tax: more time since April 2023

While a married couple live together, they can transfer assets between them without capital gains tax, on a no gain, no loss basis. For transfers from 6 April 2023: separated spouses and civil partners have until the end of the third tax year after the year of separation, or until divorce if that comes sooner.

Better still: transfers under a formal divorce or separation agreement or a court order stay tax-neutral with no deadline at all. Transfer the portfolio or the let flat years later because the order says so, and no capital gains tax arises. The recipient takes over the base cost and pays tax on the gain on a later sale. How high that tax is today is in UK capital gains tax.

The family home

For your own home the UK has private residence relief. Whoever moves out keeps it for the time they lived there, plus the last 9 months before the sale. If the sale takes longer, say because the children stay in the house until they finish school, the one who moved out can still treat the period afterwards as if they had lived there. The conditions: the sale takes place under a formal agreement or court order, the former partner lives in the house until then, and the one who moved out has not nominated another home as their main residence. The price: no relief on their new home for that period.

Often the partner moving out transfers their share to the other and keeps a right to part of the later sale proceeds. That later share stays relieved too, to the same extent as the original transfer. If you no longer live in the UK and sell UK property, the non-resident rules apply as well; see selling UK property.

No stamp duty on transfers under a court order

Buy out a partner's share of the house and you normally pay Stamp Duty Land Tax on the consideration. Not on separation and divorce: if a spouse or civil partner transfers land under an agreement or court order in connection with divorce, dissolution of a civil partnership, annulment or judicial separation, no Stamp Duty Land Tax is due. No return to HMRC is needed either, whatever the value. Property in Scotland and Wales has its own land taxes.

Sharing pensions

Pensions are part of the assets that can be divided on a divorce in the UK, including state and private pensions. The most important practical point is the order: you apply for the financial order before the final order or decree absolute. Apply afterwards and you risk financial disadvantage, especially with pensions. How UK pensions are taxed later is in pensions and investments in the UK.

Inheritance tax: the spouse exemption ends with the divorce

Separated spouses are still spouses for inheritance tax. Transfers between them stay exempt, including as part of the separation, until the decree absolute for a marriage or the final order for a civil partnership. After that they are strangers to each other. Payments and transfers agreed on the breakdown of a marriage are often not chargeable transfers at all, because they are part of the financial settlement and not a gift.

If one partner dies during the separation, the spouse exemption still applies, including to what they leave the other by will. If you do not want that, change your will. The cap on the spouse exemption for partners who are not long-term UK residents applies here too; more in UK inheritance tax.

For couples with links to the UK and to another country, the question of which country hears the divorce and whose law governs the division of assets comes up early. That is a legal question, and it can change the result a great deal. It belongs with a family lawyer. Our job is the tax side: which transfer triggers tax in the UK, which at home, and in what order to transfer what.

FAQ

Frequently asked questions

Do I pay capital gains tax if I transfer shares to my spouse after separating?

Not if the transfer happens by the end of the third tax year after the year of separation and before the divorce, or if it is made under a formal agreement or court order. Then it is tax-neutral.

Is stamp duty due if I buy out my ex-partner's share of the house?

Not if the transfer is made under an agreement or court order in connection with divorce, annulment or judicial separation. No SDLT return is needed then either.

Does my separated spouse inherit tax-free?

Yes, the spouse exemption continues until the decree absolute or final order. If you do not want that, update your will.
