Legal Requirements
When you employ someone in the UK, your UK subsidiary/branch or your non-UK business must register as an employer with HMRC even if you only have one employee.
As a UK employer, you are legally responsible for all payroll tasks. These include:
- Collecting payroll taxes (PAYE and National Insurance) from your employees´ salaries.
- Issuing payslips showing all deductions.
- Reporting your employees´ payments and deductions to HMRC on or before each payday.
- Informing HMRC if you´ve not paid any employees in a tax month.
- Notifying HMRC when you take on a new employee. Each new hire has to present you with a P45 from their previous employer. This form details the salary and taxes the person has paid so far in the tax year.
- If the employee doesn´t have a P45, they will need to complete the HMRC´s Starter Checklist. This will give you the correct tax code to use for them.
- Processing statutory payments such as maternity pay, paternity pay and sick pay through the payroll.
- Providing HMRC with a tax report at the end of the year that includes information about any expenses and benefits.
